5 § 4701: Remedies for Human Trafficking
A human trafficking offense* includes kidnapping, criminal restraint, sex trafficking or aggravated sex trafficking. Any victim of these crimes is entitled to bring a civil action for damages.
*A “human trafficking offense” includes aggravated sex trafficking and sex trafficking and all offenses in Title 17-A, chapters 11, 12 & 13 (sexual assault, sexual exploitation of minors, kidnapping & criminal restraint) if accompanied by the destruction, concealment, or removal of immigration documents or government identification, or causing a person to believe that if they do not perform certain labor or services, including prostitution, that they or a 3rd person will be subject to harm to their health, safety or immigration status.
